First on Fox: A Senate Republican wants the Department of Justice to investigate, and probably prosecute, former Special Advocate Jack Smith on whether he took illegally political action against President Donald Trump “to influence the 2024 election”.

Arkanses Republican wrote, “The office of the Special Counsel is tasked to ensure that the federal employees are not operating the biased political activity under the guise of their federal employment, you are well located to determine whether Smith has broken the law.”
He said, “There is no justification other than Smith’s efforts to influence the 2024 election results in many legal tasks – tasks that will violate the federal law,” they continued.
Smith was tapped by former Attorney General Meric Garland to investigate the allegations that Trump demanded the 2020 election results to be reversed, and later checked the handling of classified documents exposed during the raid in Trump’s Mar-e-Lego campus.

Cotton listed four examples during Smith’s tenure, where he alleged that the prosecutor extended the trial dates and “published information with no legitimate purpose”.
In one example, Cotton accused Smith of fast-tracking for the trial date and the selection of the jury, which relates to his August 2023 prosecution against Trump, which was part of his 2020 election investigation.
The prosecution included four allegations against the President, including a conspiracy to cheat the United States, obstruct an official action, a conspiracy to obstruct official action and a conspiracy against rights.
Cotton argued that, usually, the defendants have more than two years for the preparation of such testing, and noticed that in 2024, the jury selection period was slate in 2024 exactly two weeks before Iowa Cocks.
He also alleged that Smith skirts the general appellate process and “failed to clarify a valid reason” The court should give his request when Smith demanded a lawsuit before the upcoming election day, the appeal wanted to review a quickly by the court and then filed a petition with the Supreme Court after his defense with the district of Columbia district in December 2023.

Cotton accused Smith of violating the “60-day rule” of the Department of Justice, which prevents the prosecution from taking which could affect the upcoming election. The allegation arising from Smith’s move to file a brief after the Supreme Court’s decision on the President’s immunity, which was slightly more than a month from the election on 26 September, 2024.
And that brief, cotton noted, crossed the normally allowed length four times and included a grand jury testimony “usually kept secret at this point in other proceedings.”

“These actions were not standard, necessary or appropriate – until Smith’s real purpose was not to affect the election,” Cotton said. “In fact, during the tenure of Special Advocate Smith, he regularly used to prosecute a republican named for the President, regularly away and used aggressive legal principles. I would add that President Biden also called President Trump during the election.”
“President Trump, of course, Joe Biden, Jack Smith, every Democrat inserted the law against him, but the amazing victory of President Trump did not excuse Smith for his illegal election intervention,” he continued. “So I ask the office of the Special Counsel to check whether Jack Smith or any member of his team has worked illegally for political purposes.”
Fox News reached Digital Smith, but did not hear immediately.
