Chief Justice of India Bra Gavai has said that the Supreme Court is not better than any High Court of the country. Speaking at an event to celebrate the 79th Independence Day on Friday, the Chief Justice said that the two courts are the same.
The Chief Justice further stated that the apex court “cannot decide the collegium of a high court” to recommend a particular name for judges.

“Ultimately, even the Supreme Court Collegium cannot direct the collegium of the High Court to recommend names … The Supreme Court is not a better court for the High Court,” Gawai said.
The CJI said, “Both the Supreme Court and the High Court are constitutional courts, and till now the constitutional plan is concerned, they are neither inferior nor better than each other.”
The Chief Justice further shared that the first call about the appointment is to be taken by the High Court Collegium.

He said, “We only recommend the names of the collegium of the High Court and request them to consider the names, and only after their satisfaction that the candidates deserve the designation, the names come to the Supreme Court,” he said.
In his speech, he also welcomed the initiative initiated by former Chief Justice Sanjeev Khanna, where the Supreme Court interacts with the candidates during the collegium selection process.
CJI Gawai said “after interacting with candidates for 10 minutes, 15 minutes or half an hour”, SC Colgentiam can find out how suitable they would be to contribute to society.
