The Allahabad High Court’s Shraddraj on Tuesday reserved his verdict on a criminal appeal filed by Samajwadi Party leader Azam Khan, which challenged his sentence and 10 years sentence by a special court in a case related to the forced eviction of Dungarpur Colony in Rampur.
Another convicted contractor Barkat Ali has also filed a criminal appeal in the High Court.
Justice Sameer Jain decided on the petitions of both Khan and Ali.
On 30 May last year, Rampur MP-MLA court sentenced Khan to 10 years imprisonment and Ali to seven years imprisonment.
In August 2019, Abrar, a resident of Dungarpur Colony, had registered a case against three people including Azam Khan, retired circle officer Elle Hasan Khan and contractor Barkat Ali at Ganj police station in Rampur.
According to the complainant, Azam Khan, Elle Hasan Khan and Barkat Ali beat him in December 2016. He too demolished her house and threatened to kill her, Abrar alleged.
Residents of Dungarpur Colony had forcibly registered 12 cases regarding eviction. Criminal cases were registered at Ganj police station under various IPC sections, including robbery, theft and attacks.
On Tuesday, Azam Khan appeared for Azam Khan, his lawyer Imran Ullah said that Abrar filed an FIR after three years and for which he clarified that since Azam Khan was a cabinet minister, he failed to make a case against him because of his chlo.
However, Azam Khan remained only a minister till 2017 and an FIR was lodged in 2019, the lawyer said that the trial court proceeded “illegal” against the appellant.
Opposing the appeal, Additional Advocate General Manish Goyal said that the trial court has passed logic and legal order. The appellant has a long criminal history and the prosecution has successfully proved its case, said Goel.
