New Delhi: A bench of the Supreme Court led by Justice Dipankar Dutta will challenge the report of the in-house inquiry on Monday in the petition of Justice Yashwant Verma, in which he was accused of complex in the cash sacks found at his official residence and then the decision to send CG Sanjeev Khanna’s decision to the President and PM with recommendation for his treatment.Justice Verma will be represented by the battery of senior advocates – Kapil Sibal, Mukul Rohtgi, Rakesh Dwivedi, Siddharth Luthra and Siddharth Aggarwal.Since most of the senior SC judges were part of the collegium and somehow or the other was introduced to the administrative proceedings related to Justice Verma, which was returned from Delhi to Allahabad HC from Delhi after discovery of cash at his residence, CJI Gawai has heard the petition led by Justice Dutt.While CJI Khanna was leading the collegium, Justice Gawai, Surya Kant and Vikram Nath were part of it. Justice Dutta is ranked 10th among the Supreme Court judges. On Wednesday, CJI Gawai heard the plea of Justice Verma on the basis that it was part of the administrative process related to the transfer of his parents Allahabad HC from Delhi HC.Senior Advocate Kapil Sibal on Wednesday requested a bench under the leadership of CJI Gawai, which was also for immediate hearing on the plea of Justice Verma, even the Lok Sabha Speaker initiated a notice related to a notice to remove the judge signed by more than 150 MPs. Sibal had told CJI that Justice Verma’s petition recommended some important constitutional questions related to the in-house report and his removal.In his petition, Justice Verma has questioned that Delhi Police and Delhi Fire Service personnel, who discovered cash, did not seize it or prepared ‘Panchnama’ (confirming the cash discovery, the statement of witnesses), which could have been an acceptable evidence alone.
