Luigi Mangione lawyers claimed that the office of Manhattan District Attorney broke the law by achieving access to its personal health records.
In filing in a new court, the defense prosecutors accuse the prosecutors of violating HIPAA, the federal law that protects medical privacy. They say that the DA office pressured Mangione’s health insurer, Etna, which was handed over to documents from any party with a court order or consent.
According to the filing, the prosecutors implicated the date of a court and used a “false and fraud” subtype, warned that it would be held in contempt of court if it does not comply.
Mangian’s lawyers are now asking the judge to approve the DA office, including the possibility of completely evacuating the allegations. They are requesting a formal clear hearing on the case.

The office of Manhattan District Attorney told Fox News that he would respond in court papers. It said that very limited information AETNA was requested and AETNA sent additional material to error.
The office said, “As soon as we know about them, they removed the material and brought it to the attention of defense and court.”
Mangione is accused of killing United Healthcare CEO Brian Thompson outside Hilton Hotel in Midtown Manhattan on December 4, 2024 just before the company’s annual investor conference.
Prosecutors say that Mangian used a homemade ghost gun equipped with a silencer and shot Thompson twice in a close range before running away from the scene.

The DA’s office argues that the murder was ideologically motivated, it was called a task that aims to “broadcast a social and political message on a large scale.” According to court filing, Mangian allegedly marked ammunition with the words “denial,” “delay,” and “depos” and described themselves as “revolutionary anarchists”.
The prosecutors cited a note to the journal entries and the FBI, in which Mangion allegedly expressed complaints against the US Healthcare System, wrote that “these parasites were just coming to this.”

Mangian has requested not to be guilty for the allegations.
Defense lawyers have gone to separate Mangione’s statements to suppress the proofs from law enforcement and their backpacks, both were obtained illegally. He has also asked the court to dismiss allegations related to terrorism, which cite double threats and constitutional concerns over concurrent state and federal prosecution.
The DA office calls it “an open and closed case” and argues that the evidence is “heavy”.

A judge will now decide whether to provide defense request for hearing on alleged HIPAA violations. The broad speed is pending for dismissing and pressing.
The state case is moving beyond a separate federal prosecution, where the government is demanding a death sentence.
