Lululemon is sueing costco, who is accusing the retailer of selling the “misleading identical” replicas of its jackets, sweatshirts and pants.
In a trial filed in the US District Court on Friday for the Central District of California, athletic and lifestyle costumes claim that some costco products copy their own designs so closely that this “trade dress” forms a violation, which happens when a product is a more copy so that it confuses consumers.
The apparel company claims that the “knockoff” design, or product “dups”, “dups,” violates the trademark law because “some customers wrongly believe that these violated products are authentic lululemone apparel.” In other cases, “customers buy specifically violated products because it is difficult to separate them from authentic lululemone products,” the case accuses.
“In fact, an objective of selling ‘dups’ is to confuse consumers after sales and after sales, assuming that ‘dups’ are the authentic products of the plaintiff, when they are not,” is accused of the trial.
The lululemon refers to itself as a “path-breaking” apparel company in the trial, which has set a new standard for the performance athletic wearing, saying that its “construction techniques” and “strategic fit” help it stand for consumers. For comment, the company based in Vancouver, Canada said it fiercely saves its products.
“As an innovation -headed company, which invests significantly in research, development and design of our products, we take responsibility to preserve and implement our intellectual property rights very seriously,” told CBS Manivach, a spokesman for the Lululemon Company.
Costco did not immediately respond to CBS Manivatch’s request for comments.
