A federal appeal court on Thursday ruled that it is unconstitutional to undergo background check for gun owners for the first law of California to buy ammunition, announcing that it violates the right to second amendment to tolerate weapons.
In a 2–1 judgment, the 9th US Circuit Court of Appeal upheld a permanent prohibition of a lower court judge, which prevented the state from implementing the law.
Circuit Judge Sandra Ekut said that the law had the right to keep and tolerate weapons “meaningfully” and failed to prove that the law 2022 US Supreme Court verdict, New York State Rifle and Pistol Association vs. Brune, was necessarily in line with the historical tradition of the country.
“To check background for shopping for all the ammunition of California, the investigation of the ammunition background of California violates the fundamental right to keep and tolerate weapons,” Ikuta wrote.
