On July 15, President Trump nominated my friend and former Golrsch clerk aide Eric Tung in the US Court of Appeal for the ninth circuit. If confirmed, the Tung Judge will succeed Sandra Ekuta, who recently assumed a senior position after a prestigious term. Judge Ekuta leaves behind a strong heritage, a Tung is equipped to maintain and expand.

Tung’s credibility is extraordinary. He earned a philosophy degree from Yale in 2006 and graduated in 2010 with high honors from Chicago Law School University. Whereas, he served as the Managing Editor of the Chicago Law Review University, one of the most rigorous legal magazines in the country.

After the law school, Tung did a clerk for two most respected jurists in the US: then-Judge Neil Gorasch Tenth circuit and Supreme Court Justice Antonin Skalia. These clerks are presented only to the legal elite. Even among that group, Tung stood outside.

Tung’s experience is far ahead of the top of the legal profession. He served in the office of the legal policy of the Department of Justice, where he helped the judicial nominees, making him a first look at him to make him a good judge. As an assistant American Attorney in Los Angeles, he prosecuted serious criminal cases, gaining an invaluable court experience. Now a partner in Jones Day, Tung handles a national level complex appellate and testing task.

Despite this impeccable record, Tung’s Senate Judicry Committee was heard by partisan theaterics. Many Democrat Senators ignored his merit and corrected the social media posts written by me. Sen Dick Durbin, D-Il. Tung, keeping in mind the canon of judicial morality, refused to weigh properly, clarifying that my opinion is not necessary.
Sen Kori Booker, DNJ, followed the suit, hit Tung on a post, where I labeled some Democrats “Evil Marxists”. Booker then attempted to cast himself as a model of bipartisan citizenship, citing his friendship with Sen John Kennedy, R-La, was easily abandoned that he once claimed that he was “complex in evil.” Again, Tung refused to be attracted to political grandeur, showing restraint and poetry we should expect a federal judge.
This crime-by-association line of the attack is dishonest and irrelevant. Tung’s record speaks for himself. Instead of joining with their legal qualities, some senators tried to hear another judiciary committee to score cheap political points. Tung never took fodder.

His enrollment also highlights the double standard in treating judicial diversity. As the son of Chinese immigrants and a fluent mandarin speaker, one feels that the democrats at least tight will be celebrated to the federal bench representing and diversity for their sacred matrix. But because he is a conservative, his background has been reduced, or also used against him. The selective celebration of diversity and identity politics in judicial nomination is shining.

The Senate should rise above the political posture and confirm Eric Tung without delay. Their confirmation will not only strengthen the ninth circuit, but will also strengthen the rule of nationwide law. The federal judiciary of President Trump will take a significant step further with the appointment of Tung, resoving with the royal, constitutional judges.
Eric Tung is actually like the judge Americans: fast, stable and clearly fair. The Senate should take action on its return and confirm it in September.
