A federal appeal court on Tuesday stopped the seven -day waiting period of New Mexico for the procurement of guns, deciding that it violates the second amendment rights of the citizens.
The decision of 2–1 by the 10th US Circuit Court of appeals leaves the law to keep a legal challenge pending and returns the case to the lower court.
The waiting period came into force in May last year and included violars being subject to a rape, but there is an exception to the permit holders hidden. Democrats took measures in an attempt to allow more time to check federal backgrounds to complete gun buyers.
Judge Timothy Tayamkovich wrote for the majority, “Cooling-off periods do not fit any historically grounded exceptions to the right to keep and tolerate weapons, and conduct burden within the scope of second amendment.” “We conclude that the waiting period of New Mexico Act is a possibility of an unconstitutional burden on the second amendment rights of its citizens.”

The Mountain States Legal Foundation and the National Rifle Association filed a lawsuit on behalf of the residents of two New Mexico, arguing that the law was unconstitutional and delayed access to firearms for domestic violence and other citizens’ victims.
The lawsuit referred to the US Supreme Court’s Landmark 2022 decision in New York State Rifle and Pistol Association vs. Brune, in which the gun restriction is unconstitutional to determine whether the gun ban is unconstitutional. To meet that standard, the government has to show that the “historical tradition of firearms regulation” supporting the law.
Michael McCoy, director of the center of the Mountain States Legal Foundation, celebrated the ruling to keep and tolerate weapons.
“The court found that there was no corresponding law from the era that would support the modern day law,” McCoy said. “For now, this means that New Mexican can buy your firearms without an arbitrary delay.”

John Cammerford, Executive Director of the National Rifle Association Institute for Legislative Action, also praised the court’s decision, saying “it acts as an important piece in destroying similar gun control laws across the country.”
In an dissatisfaction, Judge Scott Matheson argued that the waiting period of New Mexico “establishes a condition or merit on the commercial sale of arms that does not serve derogatory ends.”

Since he was sworn in as a governor in 2019, Lujan Grisham has signed several gun control measures, including a “red flag” law, allowing a court to temporarily hurt himself or others and allow the gun to be removed in suspicion of the risk of restrictions on firearms.
In 2023, the Governor suspended the right to carry guns in public parks and playgrounds in Albuquerk in response to firing across the state, killing children.
Lujan Grisham announced an emergency situation in Albuqueck earlier this year, saying that a significant increase in crime warned with the help of the state’s national guard. He also declared a situation of emergency last week on violent crime and drug trafficking in parts of North New Mexico.
Legal experts have said that the ruling can have widespread consequences as other states including California, Hawaii and Illinois have imposed similar restrictions on gun purchases. In New Mexico, the waiting period applies to all licensed dealer firearm sale that is for handgun and long guns. The only exception applies to hidden carry permit holders, law enforcement and immediate family transfer. In support of the waiting period laws, those people argue that the research lines the law with less suicides and obsession of impulsive behavior. New Mexico officials have not said whether they would review the full 10th circuit or appeal directly to the US Supreme Court.
