The Kerala High Court on Wednesday decided to watch the Malayalam film ‘JSK: Janaki V/S State of Kerala’, before he heard his title listening to the matter related to the objections raised by the Central Board of Film Certification (CBFC).
The film’s producer Cosmos Entertainments, starring the film starring actor and Union Minister of State, Suresh Gopi, transferred HC in June against the delay by CBFC in giving censor certificate to the film. The film was later sent to the CBFC Amendment Committee for further investigation. CBFC has since referred to a Hindu goddess in the title of the film and its use in the film that talks about sexual violence will ange religious sentiments.
The producers have said that the film tells Janaki’s story, a woman who survived rape and later appealed for justice through a legal system.
On Wednesday, when the case came for hearing, the HC Bench of Justice N. Nagresh saw orally that it is appropriate to watch the film before passing the order. The judge directed the film’s makers to set up a screening on 5 July and posted the case for further hearing on 9 July.
Earlier, Justice Nagresh had explained why a person who remained from rape could not be named and has come out in CBFC to intervene with artistic freedom.
“Now you will determine the directors and artists what names they should use and what stories they should tell. What is wrong with the people? People are not a rapist. If a rapist is named after Ram, Krishna, Janaki, I can understand. What is the problem with that name?” The judge asked.
On Monday, members of the Bodies of Malayalam film actors and producers protested in front of the CBFC Regional Office in Thiruvananthapuram to change the title and lead character of the film.
