Kilmar Abrego Garcia has been detained after arriving at an American immigration and customs enforcement (ICE) office in Baltimore.
In a statement, Homeland Security Secretary Christie Nom confirmed his arrest and said the ICE “is processing him for exile”.
He was accidentally sent to a notorious jail in Al Salvador in March, and then brought back to face criminal allegations.
US officials have informed them that they can be sent to Uganda, after refusing to accept a petition deal, his lawyers say.
His legal team accused the US that he was trying to “force” to blame him by threatening to re -tell him “halfway worldwide”.
“The only reason is that they have chosen to detain him, punish him, punish him to exercise his constitutional rights,” a lawyer, Simon Sandowal-Moshebberg told reporters outside the ice office.
He said that Shri Abrego Garcia filed a new federal trial in Maryland, until he tested, was “challenging his current detention and potential exile”.
A latter court order prevented the government from removing Shri Abrego Garcia from continental United States or changing its legal status until 16:00 Wednesday, until a judge expands the order.

The saga of the exile case of Shri Abrego Garcia is in the news since March when he was sent to his original Lalwador, and was initially kept in the notorious Sekot Jail.
But after the US government officials accepted that he was deported due to “administrative error”, a judge ordered the administration to facilitate his return.
He was sent to Tenasi, where he was accused in a human trafficking scheme and was detained until his release on Friday after his decision by a federal judge.
Mr. Abrego is Garcia Not guilty for allegations.
