New Delhi: The Supreme Court on Thursday sought a response from the Center to a petition demanding the restoration of the state to Jammu and Kashmir, but said that such a decision could not be taken out without considering the prevailing tax situation and incidents such as Pahalgam, where terrorists killed 26 people in cold blood on 22 April.Senior advocate Gopal Shankaranarayanan, who was present for Zahur Ahmed Bhat, said that the decision of the 5 -judge bench of SC under the leadership of CJI then was included on December 11, 2023, which gave special status for SKD, which gives special status for two UT. Mehta’a categorized “State’s restoration will be as soon as possible and as soon as possible”. Shankanarayan said that after more than a year and a half, the state was not restored.Mehta said the election was held to the Legislative Assembly of Jammu and Kashmir, as given in the apex court in 2023. He said, “SC is aware of the peculiar situation prevalent in J&K. Many aspects should be taken into consideration before the decision to give the state to Jammu and Kashmir. It is not the time (for the petitioners) to manipulate water,” he said.CJI Gawai -led bench agreed with SG. The bench said, “The ground realities prevalent in J&K have to be taken into account. The Pahalgam incident cannot be ignored,” the bench said, and asked the Center to register its response to the state demand in eight weeks. In the December 2023 judgment, a five-judge bench had registered: “The Solicitor General said that the kingdom of Jammu and Kashmir would be restored (except for carving out of Ladakh’s center region). In view of the statement, we do not have to determine whether the state of Jammu and Kashmir is acceptable under Article 3 of the Constitution in two centers of Ladakh and Jammu and Kashmir.,“However, we maintain the validity of the decision to take out the center region of Ladakh in view of Article 3 (A), which is read with clarification, which allows to separate a region from any state and create a center area.
