Under the new schemes announced by the Justice Secretary, foreign criminals will face immediate exile after receiving the sentence of Custodial.
Under proposals, people who are given to certain period of time can be directly deported and will be prevented from entering the UK again.
The Ministry of Justice (Moj) told the BBC whether they go abroad to serve their sentences, it would be decided. In theory, this means that some criminals may be able to be free on arrival in their destination country.
According to the government, foreign criminals cost about 12% percent of the jail population, on an average at prison locations at £ 54,000 per year.
It says that new powers will save money for British taxpayers and protect the public.
Terrorists and killers like life sentence, will serve their entire prison sentence in Britain before considering for exile.
Once a Custodial is sentenced by a judge, it is decided whether someone will be deported, it will fall to a gel governor.
The authorities maintained the power to keep the culprits into custody, for example, they were planning further crimes against the interests of the UK or were seen as a threat to national security.
The Moj told BBC that the definition of a foreign national is based on the conditions prescribed in the Nationality, Immigration and Asylum Act.
If passed, new powers can already be applied to those in jail, which means that the government can start exile immediately. By January 2024, there were about 10,400 foreign nationals in the prison system.
Justice Secretary Shabana Mahmood said that “packing” will be sent to foreign criminals if they “misuse our hospitality and break our laws”.
“This government is taking radical action to deport foreign criminals, as part of our plan for change. Exile is under this government, and with this new law they will be more faster than before and before,” he said.
Shadow Justice Secretary Robert Jenrich criticized the schemes, warning that some countries may refuse to take out the exile.
“If the country will not withdraw its citizens, the starrer should suspend visas and foreign aid. Their soft-touch approach is not working,” he said.
The announcement comes after a twice in the law in June, it is expected to be implemented in September, meaning that prisoners will face 30% exile in a prison sentence instead of current 50%.
The government will now need to greenlite its proposal to Parliament so that it can be brought down to 0%.
