The US Office of Special Council (OSC) is investigating former Special Advocate Jack Smith, OSC has confirmed Fox News.
Smith was tapped in 2022 by the then Attorney General Merry Garland to work as a special lawyer about two investigations related to President Donald Trump.
The OSC is investigating Smith for allegedly violating the Hatch Act, which prevents government employees from participating in political activities. This is not a criminal investigation.
Fox News Digital arrived at the White House for comment on Saturday, but received no response.

The OSC is not the same as a special lawyer appointed by an Attorney General, as Smith, but “an independent federal investigative and prosecution agency,” according to its website.
“OSC’s statutory authority comes from four federal laws: Civil Services Reform Act, Whistleblower Protection Act, Hatch Act, and Uniform Service Employment and Unemployment Rights Act (Userra),” website describes the website.

Arkansas’s Republican Sen Tom Cotton recently asked the OSC to see if Smith is illegally engaged in political activity to influence the 2024 election against Trump.
Cotton said, “I request the office of the Special Counsel to investigate whether Special Advocate Jack Smith for Attorney General Meric Garland, Jack Smith, illegally took political action illegally to influence the 2024 election to damage President Donald Trump.” Letter To act as special lawyer Jaimison Greer.

“President Trump definitely deprived Joe Biden, Jack Smith, every Democrat, who launched the law against him, but the amazing victory of President Trump did not excuse Smith for responsibility for his illegal election intervention. So I ask a special counsel to check whether Jack Smith or any member of his team has worked for political symptoms,” wrote.
