A former NHS manager, who was awarded about £ 24,000 in compensation for unfair dismissal, has won his latest legal battle against the hospital’s trust.
Mark Hempil, who was doing chemotherapy working as a health and safety manager, was struggling with the responsibilities that were not mentioned in 2024 with an employment tribunal, Swindon’s Great Western Hospital with the Great Western Hospital.
The judge ruled Mr. Hemfil, the trust of the hospital, under the then head of Kevin McAnamara, was subject to “cruel and bullying” conduct. The appeal by the trust has now been rejected.
Trust President Liam Coleman said that it “strongly denies the allegations of the culture of bullying”.
Mr. Hemfil said that he was forced to resign in July 2022 after he failed an application for “retired and returns” under the NHS scheme.

The Great Western Hospitals NHS Foundation Trust did not challenge the overall discovery of Judge Street’s creative dismissal.
However, it appealed to the judge to reconsider some parts of his argument, which implicated Mr. McAnamara in bullying.
In March 2024, the judge refused an application to reconsider, so the trust lodged an appeal against the refusal. In July 2025, the appeal was rejected.
‘Bad dreams’
Mr. Hemfil said: “It was forced to quit the job that I loved the most painful in my life since the last three years.
“With no available legal representation or assistance to fight the barrister, lawyers and the entire legal team of the trust, there was a literally nightmare and endless sleep items.
“I felt on the moon when the final appeal from the trust was rejected and thought that it might be a big relief.”
Mr. McNamara is now the CEO of Gloster’seri Hospitals NHS Trust.
Debora Evans, who presided over the trust, had earlier stated that he had no concern about the appointment between the claims of the bullying during his previous job or now “no concern.
Mr. Coleman said: “The Trust respects the legal process and ensures that he worked appropriately when he rejected Mr. Hemfil’s retired and returns request.”
